Declaring Personal Bankruptcy

By | 1 Comments | Rating: 0 | |

Many people do not understand the process involved in declaring personal bankruptcy. There are many myths and false truths that cause people to make many mistakes when declaring personal bankruptcy. Before you file, you should research bankruptcy and learn all you can about what is involved.

You will not find an easy fix for financial struggles by declaring personal bankruptcy. When you file for bankruptcy, you will not be able to clear out every debt you have. There are certain debts such as court ordered payments and school loans that you cannot discharge with bankruptcy.

Look carefully at all of your debts and determine which debts are declarable. This will help you decide if declaring personal bankruptcy is a wise decision.

You should also keep in mind that declaring personal bankruptcy will not fix any credit issues you may have. In fact, your credit will actually take a significant hit with bankruptcy. When creditors look at your credit, the only thing they will have to consider is your bankruptcy. This tells the creditor that you could not handle credit in the past and they will most likely decline your application.

Declaring personal bankruptcy is much more difficult now than it used to be. New guidelines and requirements force you to be more involved in bankruptcy procedures and make the process much longer than in the past. Your lawyer can't just walk in and take care of everything for you.

You may even stand to lose some of your assets. You could lose your property, vehicle, or other personal effects, depending on how many exemptions you are allowed. If you file Chapter 7 bankruptcy, this is what happens. If you file Chapter 11, you may protect your assets, but you will have a payment plan to repay your debts rather than clear them away.

You also need to take steps to make sure that you can manage your finances more successfully once you file, due to the limits placed on filing. If you fear that filing for bankruptcy may not be enough to help you completely recover from your financial problems, you might want to wait on filing.

Talking with your lawyer is the best way to decide if declaring personal bankruptcy is a wise choice. Learn as much as you can before filing, and be certain that it is the right decision.
