Is divorce without the help of a lawyer possible? Divorce without a lawyer is indeed possible and is also very economical and practical for those who do not want to pay a lawyer for this service. This kind of a divorce is ideal for those couples who do not have shared assets, no dependents and no children and for those who essentially want to legally separate but do not want to shell out lawyer's fees for something that can be done without a lawyer's help. Divorce without a lawyer is called a Pro Se Divorce. Filing for a divorce without the outside help of lawyers can be done by both parties as long as they are in complete agreement to it.

The main reasons for getting a Pro Se divorce is often financial however, there are other reasons that couples can cite for doing their divorce themselves without these lawyers. Divorce without a lawyer is sometimes undertaken by the couple themselves to expedite the process and to avoid undue stress and agony over a prolonged case. How a Pro Se divorce works is not easy though and it is something that not all divorcing couples can avail of either. There are factors that affect a do-it-yourself divorce and these factors or criteria include the self filing and completion of papers of both parties for the divorce. Neither partner can contest the divorce. Both also have to file for this kind of a divorce. This means that one side using a lawyer while the other files Pro Se cannot happen and is not allowed.

Other rules and considerations that cover this kind of a divorce include the exclusion of alimony claims, contesting of properties and assets and such. It is essential also that both partners be financially independent of each other before they can file for a Pro Se divorce. This means that they can live comfortably on their own without needing financial assistance from their former spouse. While this rule may make this kind of a divorce seem like something only well-to-do individuals can undertake, it is actually done this way to ensure that the couple breaks free of each other without any more obligations or responsibilities towards each other. This also ensures that they can break the marriage up without having to worry about the other party getting the raw end of the deal. People can look for specialists like divorce lawyers for men.

When it comes to children and this no-fault divorce, only couples without children or those with children who are above the legal age can file for a Pro Se divorce. If there is a history of mental or physical abuse that went on between you and your partner, this divorce is not suitable for you. Cases of bankruptcy and being in debt should also be absent when you are trying to file for this kind of a divorce. Military personnel are not allowed to divorce using this method as well. While there are a lot of things that need to be considered and weeded out before you can qualify for this kind of a divorce, the amount you can save in lawyer's fees may just make the effort well worth it.

Very interesting article detailing a Pro Se (divorce without a lawyer.) I was unaware of this type of divorce, so I found this fascinating. It seems like it would be more suited for those who want a quick no nonsense divorce with less complicated circumstances.
