Employment Law: Knowing Your Rights in the Workplace

An employee's main purpose is to provide manpower to the company owner. In return, the employer should pay him accordingly and make sure his rights are protected at work. Before a person begins to work, he should become familiar with his rights as an employee. Below is a summary of all employee rights in the workplace:

Rights during the hiring process

When applying for a job, individuals already have certain rights even if they are not employees yet. For instance, interviewers are not allowed to discriminate against them on the basis of their race, religion, age, or disability. They also have the right to know what kind of employment they are entering.

Wage and hour rights

Once hired by the company, an employee has the right to get the right amount of salary based on his working hours. Overtime, meal breaks, and minimum wage issues are some of the things that he should remember.

Right to take time offs or leaves

As an employee, he has the right to obtain medical and sick leaves in case he suffers an injury or disability. Female workers may also take 12 weeks of pregnancy leave to give them time with their babies.

Rights against harassment and discrimination

Harassment and discrimination are some of the most talked about employment issues today. Under federal and state laws, all employees are protected from discriminatory and harassment practices. Violators of these laws will be dealt with accordingly.

Right to safety

Because employees work for the benefit of the company owner, he should make sure to keep them safe. The Occupational Safety and Health Administration (OSHA) is the federal employment agency that enforces this employee right.

Compensation and benefit rights

In case an employee gets injured at work, the company should be the one to pay for his medical expenses. The employer can provide workers' compensation through a third-party insurance company.

Privacy rights

Even if an employer "owns" an employee's work, he does not necessarily own him. This means he still keeps his privacy rights in checking messages, and doing some personal things. Installation of surveillance cameras in the workplace should also be kept to a minimum.

Right to leave the company and obtain unemployment benefits

An employee has the right to leave the company for whatever reason. Once he has resigned, the employer should provide him unemployment benefits or a severance package depending on their contract.
