How to Deal with Collection Agencies
Nobody ever hopes to get a call from a bill collector, in fact dealing with collection can be one of the most unpleasant things that no one would ever hope. But that doesn't mean that collection agencies phone calls have to be a source of shame. The simple fact of it is that nearly everyone will get a call from a bill collector, or even a collection call at work. And, while yes these things can be frustrating and embarrassing, these things do not indicate that a person is a deadbeat or a bad person. It simply means that they have to get better at knowing how to deal with collection agencies!
You see, the good news is that there are legal protections for people who are getting harassing phone calls, and especially phone calls at work, that you can assert when dealing with bill collectors. These laws have been established to protect citizens from aggressive collection calls and try to regain some of their dignity. Remember, as I said, that going through the collection process or not being able to pay a bill does not make a person a failure or bad. It is something that most everyone will deal with at some point or another.
Every citizen has rights and these rights do not go away if you have an unpaid bill or owe someone money. One of the primary rules when it comes to knowing how to deal with collection is to understand your rights in the process. It is vital that you take a little bit of time to educate yourself to the laws that establish what behavior a bill collector may or not practice when trying to collect a debt. Once you are familiar with such laws you will be able to assert your rights and, generally, you will be able to make the whole process a lot less painful.
The main law which protects people against collection agencies is called the Fair Debt Collection Practices Act which sets down the specific that collection agencies have to follow when they are trying to collect. This law, also known as the FDCPA, has many parts but the main ideas that you need to be aware are those parts which concern your rights. Among your legal rights when dealing with collection agencies is the limiting of phone calls to the hours between 9 AM and 8 PM and the fact that collection agencies can only talk to the person with whom they have the outstanding debt not that person's family members or co-workers.
The reason that the government has enacted the FDCPA is to give ordinary people a chance when they have to deal with harassing collection agencies. All collection agencies are sent documentation of these laws and they are forced to comply with them or they may face substantial fines. The only problem with this legislation is that so many people who are currently getting harassed by collection agencies do not know their rights.
But knowing your legal rights is only half of the battle. It is also important that you have a strategy for dealing with collection agencies that will settle your balance and get them off your back. For instance, are you aware of the fact that you can negotiate with collection agencies? Many people are not and assume that they have to pay the full amount in order to satisfy the debt. This is not true. The fact of the matter is that most debts have been purchased by debt collectors for pennies on the dollar and that they will gladly take less than you actually owe (sometimes a lot less) because they will still make money.
This is one of the things that ordinary people need to be aware. If you owe $300 and do not have all $300 you can probably get the collection agency to take $150. All you have to do is to negotiate with them. Now, it does take a little practice to begin to learn how to do this but, in time, you will be settling your debts for a fraction of the quoted amount.
The final thing that you need to realize is that there are things that you can do to stop the harassing phone calls even if you do not have the money to settle with the collection agency. Knowing your rights is only the first step. Sometimes you have to use every weapon at your disposal. Therefore it is critical that you educate yourself in every method that you can use to stop harassing collection calls. There are simply too many techniques for me to describe here, but you should not stop searching until you have found a technique that will work in your case.
Knowing how to deal with collection agencies effectively can mean the difference between a minor annoyance and a major headache. Therefore the steps that you take when dealing with creditors can help alleviate the overall unpleasantness of the situation. So, educate yourself about your rights.
