Important Factors about the Family and Medical Leave Act

When an employee becomes sick, pregnant, or when one of her relatives acquires a serious illness, she has the right to take a medical leave. Under the Family and Medical Leave Act (FMLA), employees can take unpaid leaves in case of emergencies, sickness or disabilities. If you are an employee and you want to know more about leaves, here are some important things about the FMLA:

  • Companies with at least 50 employees are covered under the FMLA.
  • An employee would be allowed to take leaves if s/he needs to meet with family responsibilities such as taking care of a baby or a sick relative.
  • Employees who are taking leaves should not be terminated or transferred to another position.
  • An employee would only be eligible of a leave if s/he has worked in the company for at least 12 months.
  • Leaves permitted by FMLA can be taken in an intermittent basis.
  • An employee requesting for a leave should inform his or her employer one month in advance.
  • The employee should submit documents and records that verify his or her illness, or the condition of the relative.
  • California has enforced additional related laws such as the Paid Family Leave (PFL) and the California Family Rights Act (CFRA).
