Is Phone Broadcasting An Illegal Way To Prospect Your MLM, Network Marketing, Or Direct Sales Business?

Phone broadcasting, also known as voice broadcasting has been around for quite a while now. Many of you have probably received some of these calls while you were eating dinner.

Some of you may have found these calls to be very annoying, and some of you perhaps found these prospecting calls to be helpful for you because you were offered goods and services that were of interest to you.

Business owners and mlm and network marketing prospectors are wondering now if phone broadcasting is illegal due to FTC changes in September of 2009 and have concerns. If voice broadcasting is illegal it can and will create panic upon those who have relied upon it for an income.

Voice broadcasting has been used as a prospecting tool for mlm, network marketing, and earn money online legitimate businesses, as well as scams.

Voice broadcasting, aka phone broadcasting has provided a lucrative source of income for individuals looking to earn line and make money from home.

We all know that when you are in an mlm, network marketing, or direct sales company, generating leads is always a difficult thing to do.

Broadcasting sales calls via the telephone has proven to be an easy to use prospecting tool for those looking to earn money in a home based business.

Some of the most popular voice broadcasting programs online today are both the Ibuzz Pro, and the Phone Broadcast Club.

The Ibuzz Pro is the more expensive of the two software programs and seems to provide a much better training program for those looking to get into voice broadcasting.

In September of 2009, however, the FTC came out with new rules regarding phone broadcasting.

A warning is now going out to anyone who uses services to automate their outbound recorded phone broadcasting telephone calls, dubbed “robocalls”.

The FTC has now prohibited its use except for certain exempt groups. The new law, Amended Telemarketing Sales Rule, is due to be in effect starting September 1st, 2009.

According to the Federal Trade Commission, there were over 14,000 comments held in discussion about this new law since 2006.

Ability to contact prospects and customers is becoming much more difficult for those in MLM, network marketing, and other types of sales businesses.

If you have any campaigns that make use of voice broadcasting for sales purposes, it’s out advice that you stop your campaign and do further research so that you will not get fined.

According to the FTC, the fine is 16,000 for each offense. For anyone using phone broadcasting as their major form of prospecting for their business, this new ruling could be very upsetting and disconcerting to say the least.

If you are using phone broadcasting as a prospecting tool, or are looking to purchase a voice broadcasting system such as IbuzzPro or the Phone Broadcast Club, it is important that you do your due diligence and perhaps even contact the FTC directly.

This author has read from various sources that the FTC ruling has an exception regarding business to business prospecting calls. An example of this would be calling somebody who has an MLM or network marketing landing page offering their own business via the internet.

So to answer your question whether or not phone broadcasting is illegal and can still be used as a prospecting tool for your home business, the answer would be both yes and no.

If you are calling business to business, you have to make sure that you do not violate any rules. Find out whether or not your prospects need to “opt-in” to receive calls from you.

Because the ruling is very new, and just came out on September 1, 2009, all of the kinks are still being worked out and understood.

By October, or November of 2009, the FTC voice broadcasting ruling should be more fully understood and integrated.

Voice broadcasting is almost illegal, but heres a fix.


FTC has changed the voice broadcasting laws as of September 2009. You will need written permission from the recipient before sending a voice broadcast message.

Voice broadcasters need to re-invent a solution to continue voice broadcasting within the constraints of the new laws. Luckily, there is a solution. A new service called voicemail courier makes it possible to resume mass communication with a pre-recorded message.

This method of mass communication is legal because a live person interacts with each call and message delivery, thereby satisfying the new voice broadcasting laws.
