Do you need to declare bankruptcy? Bankruptcy is often necessary when someone has built up more debt than they can manage to pay back. They cannot afford the minimum monthly payments and they cannot get ahead. To deal with this, they decide to declare bankruptcy.

How is it during this time period? Bankruptcy isn't exactly the fastest process in the world. Chapter 13 bankruptcy can take from 3 to 5 years and chapter 7 as much as six months to get all your debts discharged. That is a long process and considering it is harder to file chapter 7 these days, you'll likely be in a long process.

Filing for bankruptcy can be a stressful process. If you don't have the help of a lawyer, it can be an even more stressful process. A lawyer with experience knows exactly what to do, how to do it, and when to do it. They can help you every step of the way.

One benefit to filing is that you can get automatic stay. You will get automatic stay if this is your first time filing, and you may or may not if you have already filed once before. Automatic stay means that creditors can't call you. If you have been in debt for a while, you have probably been getting creditor calls and possibly harassing calls. This is one thing that can make you feel a lot better.

Basically, you can't understand life during bankruptcy unless you go through it. It might be more stressful for someone else who has more debt than you or for someone who has to go through it longer. Either way, it is not fun and you should avoid it if you can.
