As a property owner, you should make sure that your property is free from any hazard which can cause injuries to your visitors. Under the premises liability law, you may be liable for the victim's injuries if it was proven that you did not take precautionary steps in order to protect him.

Slip and fall is a kind of accident that can happen on your property. In order to avoid being sued, make sure that all the areas on your property like stairs and floors are properly maintained or managed.

Stairs

The materials that are used when making stairs can become damaged as time passes, so the stairs in your home or building should always be maintained. Remember, it is your job to protect the people who are using them. You may be responsible for a victim's injuries if you failed to repair them even if you are aware that they are already dangerous to use.

To be more specific, you may be held liable in a slip and fall accident if it occurred due to the following reasons:

  • Debris like gum, plastic cup, mud, and paper on the stairs
  • Broken or missing handrail

Floors

You will need to wax, polish, or mop the floor so that it will remain clean and be pleasant to look at. However, you should be careful when doing so because an accident can happen if:

  • You applied a certain floor treatment on an inclining or sloping floor area
  • You failed to warn people that the floor is still damp or wet
  • You polished one area while leaving the others untouched

Outdoors

You should also responsible in maintaining the areas outside of your property. One of the things that you need to do to is to make sure that these areas have proper lighting. If you failed to do so, someone may slip due to unnoticed debris or fall due to dark stairways. In this case, you may be required to compensate the victim if you are aware of should have been aware of the inadequate lighting, but you did not do anything about it.
