By | Jun 22, 2010 | 0 Comments | Rating: 0

Driving Under Influence (DUI) is one of the leading causes of accident on the road. Intoxication from alcohol or drugs affects driving response to traffic signals and objects on the road. An increasing rate of violators is from teenagers who are or recently with their friends.

California law implements a no tolerance rule on alcohol and drugs among motorist, which requires a Blood Alcohol Content (BAC) of not more than .08 percent. This means that no illegal amount of alcohol or drugs should enter your body before and during driving. DUI is a negligent act that has grave penalties under existing California laws.

A California Highway Patrol officer may ask you to stop, pull over, and take a BAC test if your driving behavior suggests intoxication from alcohol or substance. The officer may cite you DUI charges if:

1. Your BAC test exceeds .08 percent

2. Your driving behavior becomes hazardous to other motorist

3. Your over speeding violation is caused by intoxication

4. There are valid testimonies on your dicing conduct and physical appearance

5. You fail to pass the field sobriety test

6. The officer see bottles of alcoholic drink in your car or drops of alcohol in your clothes that proves your drunk behavior

The police officer may ask you to undergo field sobriety test. This is composed of physical agility tests that measures how you can respond to stimulus or commands under reasonable standards.

This is composed of nystagmus (ability to focus on objects using the eye), walk and turn, standing on one leg, finger to nose, and Rhomberg balance test. These exercises are designed to measure how reasonable or normal your response is to the set of stimulus and commands.

Other exercises may include counting backwards, hand clapping, and other psychomotor activities. This may be succeeded with a Preliminary Alcohol Screening (PAS) test. This is a breath test to detect presence of alcohol.

If you receive DUI charge, your license may be suspended for months or a year depending on the hazard or injury you have caused on the road. This violation will reflect in your driving history. This information is accessible by insurance providers and government agencies. This may affect your insurance premium and cause you fines along with other court penalties.

DUI may cause other road hazards such as:

  1. Car accident
  2. Motorcycle accident
  3. Pedestrian accident
  4. Bicycle accident
  5. Boating accident
  6. Recreational vehicle accident

If you are charged with DUI violation, you may seek a professional lawyer to help you clarify your negligent act. A professional Personal Injury Lawyer in Los Angeles may help you meet the requirements of the court and settle compensation to speed up the process in regaining your license. Make that move now.
