What Happens When I File A Car Accident Compensation Claim?

By Edited Nov 13, 2013 0 1

It wasn't your fault, but you have just been involved in a bad car wreck and you have been injured. You have never filed a car accident compensation claim, where do you start?

Car Accident Compensation 101

To drive legally, you must have auto insurance and all auto insurance companies provide for a procedure for filing a car accident compensation claim. You could do it yourself, if you wanted to.

Most of the time, the police interviewed and got the insurance information of the people involved in the accident at the scene of the collision. Also, the police probably made a determination of who was responsible for the mishap. This police report will be the basis on which your claims will be based.

What Were The Damages That You Had?

Your damages may include auto replacement if your car was totaled, rehabilitation and medical treatment, auto repair and rental car cost while yours was in the shop, possible loss of income, ambulance cost, and other miscellaneous costs. Insurance main purpose is to "make you whole" again both financially, physically and mentally. It is also possible that you could have a claim for "punitive" damages if the accident was caused by negligence, carelessness or a defect in the vehicle.

The Help That Counts

It isn't always as easy as just filing a claim with the insurance company and collecting money. It is possible that someone involved in the accident may sue you personally or that the insurance company may deny coverage based on a policy provision technicality So, it is almost always a good idea to hire a good personal injury attorney.

A personal injury law firm will be able to represent you with the insurance company and they will know the law regarding car accident compensation claims in your jurisdiction. If a lawsuit is needed, a personal injury attorney may represent you in court and see that you receive the compensation that is due you.

Many PI attorneys work on a percentage of the award, a contingency fee, meaning that, in most cases, you have no up front costs. By hiring a personal injury law firm, in many institutes, you will receive a larger award then if you had represented yourself in the case. Plus you have the peace of mind having someone who knows the law represents you.

The Bottom Line For You

An car accident is never fun and can cause you mental and physical trauma. How you handle it after the wreck will determine how you come out both physically and financially. A medical professional will help you heal physically and a personal injury attorney may be what you need to get the compensation due you.

This is a great article to inform personal injury victims about their legal options.

If a victim needs an attorney for his claim, he should make sure that he works on a contingency basis. This way the attorney would not be able to demand attorney fees unless he is able to win the case.
