Wrongful Death Attorney
Wrongful deaths are caused by the recklessness, inaction or negligence
by an organization or another person. Medical malpractice is among the
leading causes of wrongful deaths, but a large number are also caused
by car accidents, workplace accidents and sometimes, defective
products. If you are in a situation like this, make sure you hire a wrongful death attorney.
United States law states that a wrongful death
lawsuit can be filed by the immediate members of the family of the
deceased. 'Immediate family' is defined as a spouse, parents, or
children, though a child would need an adult to serve as guardian. A
wrongful death lawsuit is a kind of civil lawsuit which seeks
remuneration for lost income, a lost inheritance or benefits, medical
expenses, emotional distress, a loss of companionship and funeral
costs.
The law will be different from state to state, but a
wrongful death lawyer will walk you through the laws and assembled a
strong lawsuit. There is a statue of limitations of between one and
three years after loved one's death for these wrongful death lawsuits.
As soon as possible after death, one should consult a wrongful death
attorney. Your wrongful death attorney will be able to verify that
someone's action, or inaction, was the cause of the death. The attorney
should also verify that there is suffering by the family members
because of this death, and that they will be compensated appropriately.
Wrongful death attorneys usually cope with families who are
grieving or distraught, as well as the complex legal problems. It's
best to choose an attorney who has experience in wrongful death
matters, and who is sensitive to the needs of an emotional family. As
with many personal injury attorneys, this lawyer might work based on
contingency, meaning that they'll only charge when the family wins the
case. Once a correct assessment of loss has been established based on
the victim's death, damages and compensation are awarded.
Death
can be a very traumatic experience, even without facing complicated
legal issues, so a good wrongful death attorney will be a valuable
asset when looking for fast compensation on the part of the victim.

This is a nice summary about what wrongful death is.
Each state has different laws regarding wrongful death including its statute of limitations.
In California, the statute of limitation is 2 years upon discovery.
Statute of limitations for medical malpractice cases, though, is much more complicated so it is best that you consult a wrongful death attorney with all the details immediately.
A very informative article that opened my eyes to this! It was well written, and provided great information.
